2.5 In the event, you grant access to any third party to our services under your account, then the terms "user", "you", "your" shall by inference include such third party, and this Data Protection Policy to the extent permitted under law shall mutatis-mutandis apply to such third party. Notwithstanding anything to the contrary, it shall be your sole responsibility to make such third-party user(s) being granted access under your authorization aware of the terms of this Data Protection Policy and adhere to its obligation. You and such user shall be jointly and severally liable to indemnify us against any claims or breach of this Policy by such third-party user(s).

3.2.2 Personal Data that is collected from other controllers
You can engage with us through other service providers like Google, and Microsoft, social media websites, or through features on Quibble AI platform that integrate with social media sites or other third parties. If you access our platform through any such other controller, the data we collect may include your user name associated with that data controller, any other information or content that such other data controller has the right to share with us, or any information you have made public in connection with that data controller's services. When you access our platform or otherwise deal with Quibble AI through other data controllers, you are authorizing Quibble AI to collect, store, process, use, and retain such information and content in accordance with this Data Protection Policy.
Other controllers hereby acknowledge that by consenting to this Data Protection Policy they are consenting to Quibble AI collecting, using, retaining, or processing the Personal Data provided to us by such other controller. It shall be the sole responsibility of the other controllers to take consent of the users to provide us with their Personal Data.
It is hereby clarified that we shall not be liable for the accuracy or authenticity of Personal Data received from any other controller. In case any other controller receives requests from the users to withdraw their consent, erase, or make corrections to their Personal Data, such other controller shall promptly notify such request and we shall be liable to fulfill such request only upon being notified by the other controller.
3.2.3 Data that is collected by virtue of usage of our services
When you use our services, we including other third parties may gain access to your Personal Data including but not limited to your name, age, gender, email, contact information, device information, and any other information that you may, with your free consent, provide to use our services including Personal Data or any other information of any third party. It is hereby clarified that in no case, Quibble AI shall not be liable to such third party whose Personal Data or information has been provided to us by you while using our services.
3.2.4 Data that is incidental to the usage of our services
We including any other controller or data processor collect, store, use, or process any of your Personal Data which is incidental or ancillary to your usage of our services and that you may provide us or any other controller by giving your consent to this Data Protection Policy.
You hereby consent that the collection and use of any Personal Data or any other information as disclosed under this Data Protection Policy shall not cause any loss to any third party or wrongful gain to youself. Further, you also hereby consent and acknowledge to be bound by the terms and conditions as detailed under the Terms of Use. You hereby consent that we may transfer your Personal Data to any other affiliates, data processors, or other controllers for its use in connection with the below-mentioned purposes.

We as well as the service providers or data processors commissioned by us, process your Personal Data for the following processing purposes:

Legitimate interest in providing our services and further enhancement and improvement in our services as may be requested by you from time to time.

5. Duration of storage, retention periods
Principally, we will retain your data for as long as you don't withdraw your consent to data processing, request to erase your Personal Data or it is necessary to render our online offers and connected services or for as long as we have a legitimate interest in storing the data (e.g., we might still have a legitimate interest in postal mail marketing after fulfillment of our contractual obligations). 6.2 You shall be solely responsible for ensuring that any Personal Data or information of third parties provided to us by you is accurate, lawful, and shared with the third parties' full, informed consent. We shall not be held liable for any discrepancies, inaccuracies, or lack of proper authorization related to this data.
6.3 We explicitly disclaim all liability for any claims, actions, damages, or expenses arising from or related to the Personal Data of third parties shared by you with us. Should any claim or action be initiated by a third party regarding their data, you agree to fully indemnify, defend, and hold us harmless against any liability, costs, or expenses, including legal fees, incurred by us as a result of such claim.
6.4 In the event of any claim arising out of or relating to our possession, processing, or use of any third-party Personal Data provided by you, you agree to indemnify, defend, and hold harmless Quibble AI and its directors, employees, and affiliates against any and all claims, damages, losses, and expenses (including but not limited to legal fees) incurred by Quibble AI as a result of such claims.
6.5 You acknowledge and agree that by providing third-party Personal Data to us, you are responsible for complying with all applicable privacy and data protection laws. We shall not be liable for any unauthorized or improper use of third-party Personal Data provided by you, and we disclaim any responsibility for ensuring compliance with such laws as it pertains to third-party data.

8. Security
The security of your Personal Data is very important to us. We use reasonable security measures, at the minimum those mandated under the applicable laws, to safeguard and protect your Personal Data.
You hereby accept the inherent security implications of providing privacy to your Personal Data shared with us and you will not hold us responsible for any breach of security or the disclosure of information unless we have been grossly and willfully negligent.
We may enter into an agreement with other controllers or data processors (in or outside of India) to store or process your Personal Data. These third parties may have their own security standards to safeguard your information or data and we will on a commercially reasonable basis require such third parties to adopt reasonable security standards to safeguard your Personal Data or information.
Not withstanding anything contained in this Data Protection Policy or elsewhere, we shall not be held responsible for any loss, damage, or misuse of your Personal Data, if such loss, damage, or misuse is attributable to a Force Majeure Event. A "Force Majeure Event" shall mean any event that is beyond our reasonable control and shall include, without limitation, sabotage, fire, flood, explosion, acts of God, civil commotion, strikes or industrial action of any kind, riots, insurrection, war, acts of government, computer hacking, unauthorized access to computer data and storage device, computer crashes, breach of security and encryption, etc.
9. Anonymized Data
You acknowledge and agree that we may create aggregated, redacted, or anonymized forms of your Personal Data that may not identify you ("Anonymized Data"). Anonymized data shall be considered our data and we may use such Anonymous Data for any purpose at any time (including without limitation to develop and improve our other products and services and to create and distribute reports and other materials).
10. Children and Disabled Persons
10.1 We do not provide services directly to children below the age of 18 years ("children") or proactively collect their Personal Data. However, we may allow children to use our services provided that their parents or legal guardians give their verifiable consent by registering their child's account on our platform as a sub-account to the parent's or guardian's account registered on our platform and that such parent and legal guardian assume all responsibility and legal liability for the conduct of their child including, without limitation, monitoring the child's access and use of our services.
10.2 If we learn that the Personal Data of a child has been collected without verifiable parental consent, causing any detrimental effect on the well-being of a child, or behavior of children, then we may take the appropriate steps to delete such information. However, if you discover your child has submitted his/ her data to us, you may have such data deleted from our database by sending an e-mail request on the email given under 'Contact Us'. Upon receiving the request, we shall ensure to delete such information from our database within a reasonable time.
10.3 A person with a disability who has a lawful guardian may use our services, provided that the legal guardians of such disabled person shall give their consent to such person using our services by registering a disabled person's account on our platform as a sub-account to the guardian's account registered on our platform. The legal guardian shall assume all responsibility and legal liability for the conduct of such person including, without limitation, monitoring the person's access and use of our services.
10.4 If we learn that our services are being used by a disabled person without obtaining verifiable consent from their legal guardian, then we may take the appropriate steps to delete such information. However, if the lawful guardian discovers the disabled person has submitted his/ her data to us without their consent, the lawful guardian may have such data deleted from our database by sending an e-mail request on the email id given under 'Contact Us'. Upon receiving the request, we shall ensure to delete such information from our database within a reasonable time.
11. User rights
To enforce your rights, please contact us using the details provided in the "Contact Us" section (see below). In doing so, please ensure that an unambiguous identification of your person is possible.
11.1 Right to request a copy of your Personal Data
In case you wish to access a summary of the Personal Data that we may hold about you or you wish to know the identity of third parties with whom we may share your Personal Data then you can request a copy of such data from us by writing on email-id using the details provided in the "Contact Us" section. Upon receiving your request, we will provide you with a readable copy of the Personal Data which we keep about you. We will provide such information without charge; however, we may charge a reasonable fee for the administrative cost of providing the information where the request for information is unfounded, repetitive, or excessive.
11.2 Right to Correction
In case you require us to rectify any inaccuracies to the Personal data that we hold about you, you may contact us using the details provided in the "Contact Us" section on our platform to rectify your data. If we have disclosed your personal data to any third parties, we will also inform those third parties of any correction to your Personal Data, where possible.
In case we receive your Personal Data through any other controller, you may request such other controller to rectify your data and such other controller shall notify us about any rectifications as may be requested by you.
11.3 Right to erasure
You may go to the settings page on our platform to erase your Personal data or contact us using the details provided in the "Contact Us" section, in the following circumstances:
- the Personal data is no longer necessary in relation to the purposes for which it was collected or otherwise processed;
- you withdraw consent on which the processing is based and there is no other legal ground for the processing of the data;
- there is no overriding legitimate interest for us to continue the processing of the data;
- your personal data was unlawfully processed; or
- your personal data must be erased in order to comply with a legal obligation.
However, we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of receiving your request.
11.4 Right to Grievance Redressal

11.6 Withdrawal of consent
Where we have relied on your consent for the processing of your Personal data, you have the right to withdraw that consent at any time. If you wish to withdraw your consent please go to the settings page on our platform. However, the lawfulness of data processing prior to your withdrawal remains unchanged.
12. Additional Rights to Users Residing in the European Union
12.1 Right to Data Portability
In case you wish to transmit the Personal Data that you have received from us in a structured, commonly used, and machine-readable format to another controller, then you can freely transmit such data to another controller without hindrance from us.
12.2 Right to restrict processing of your Personal Data
You have the right to restrict the processing of your Personal Data in the following circumstances:
- you contest the accuracy of the Personal data;
- you have objected to our processing of your Personal Data;
- the processing is unlawful and you do not wish for the data to be erased but require restricted processing of the data instead; or
- we no longer require your personal data but you require the data to establish, exercise, or defend a legal claim.
When processing of your Personal Data has been restricted, we will be permitted to store your data but will not perform any other processing of it, unless you consent to further processing or processing is necessary for the establishment of a legal claim; for the protection of rights of another person; or for reasons of important public interest.
12.3 Right to object to processing your Personal Data
You have the right to object to us processing your Personal Data where our legal basis for processing the data is:
- for direct marketing purposes (including profiling), we will stop processing your personal data for this purpose; and

12.4 Right to oppose Automated Decision-Making and Profiling

- is not authorized by laws to which we are a subject

13. Limitation of Liability
13.1 We shall not be liable under any circumstances for any indirect, special, consequential, or incidental loss, exemplary or other such damages, including, without limitation, damages arising out of or relating to breach, misuse, or corruption of data/information shared by You.
13.2 Unless prohibited under the applicable laws, our maximum aggregate liability for all claims arising out of or in connection with the services shall not exceed the amount paid by you to us during two (2) months period immediately preceding the incident (or the first incident in a series) giving rise to any claim for damages.
14. Important Disclaimer
Although Quibble AI provides full security and secrecy to your Personal Data, we urge you to be careful while sharing your Personal Data with any third party claiming to be related to Quibble AI on emails/phone calls, etc. We disclaim any and all liabilities towards any such claims that have arisen due to your own negligence or willful misconduct and we take no responsibility for the same. Further, we are not responsible for the authenticity of the Personal Data provided by you.
15. Changes to the Data Protection Policy
We reserve the right to change, modify, add, or remove portions of this Data Protection Policy at any time for any reason at our absolute and sole discretion. You can access the latest version of this Data Protection Policy at any given time from our Platform and it shall be your responsibility to stay updated on any changes to this Data Protection Policy. Once posted, those changes are effective immediately, unless stated otherwise. In case you disapprove of this policy or withdraw your consent then you should immediately cease to use the platform. The terms of this Data Protection Policy shall be read with and as an integral part of the Terms of Use of our platform.
